Terms of Use

These Terms of Use ("Terms") govern your use of the Offbeat Music Player mobile application for iOS and iPadOS (the "App"), the website at https://offbeatplayer.com (the "Website"), and related services. By installing or using Offbeat, you agree to these Terms. If you do not agree, do not install or use the App or Website.

The End-User License Agreement for paid subscriptions is provided through Apple's standard EULA (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). Where these Terms conflict with Apple's EULA on subscription issues, Apple's EULA controls.

1. About us

Offbeat is published by Offbeat. References to "we", "us", and "our" mean Offbeat. Contact: [email protected]. Privacy questions: [email protected].

2. Eligibility

  • The App's free features are available to anyone aged 4 and over.
  • Account-bearing features (email sign-up, Apple ID sign-up, Google sign-up, paid subscriptions) are limited to users aged 13 or older per Google's ToS, Apple's ID requirements, and the App Store Review Guidelines. The App will show a confirmation question before letting you create an account.
  • We may refuse, suspend, or terminate the account of anyone under 13 who successfully creates an account, and we will delete any data we have collected from them.

3. Using Offbeat

You are responsible for the media and other content you import, create, edit, export, or share through Offbeat. Use the App only with content you have the right to use, and do not use Offbeat in a way that violates copyright, licensing terms, platform rules, or applicable law.

4. Lyrics and user-provided text

Offbeat does not provide, host, or distribute lyrics or sheet music as a content library. Users may add their own lyrics content only. By adding, importing, syncing, or using lyrics in Offbeat, you represent that you own the content or have the necessary rights or permission to use it. Optional lyrics search may send title / artist / album metadata to a third-party lyrics search provider you choose to use (see the Privacy Policy).

5. Your account

  • You must provide accurate, current information during sign-up.
  • You are responsible for keeping your password and device secure. Use a unique password. Enable a device passcode / Face ID.
  • Notify us immediately if you suspect unauthorised access.
  • We may suspend or terminate accounts that violate these Terms.

6. Paid subscriptions

See Subscription Terms for the full subscription rules. In short:

  • Some features may require an account or a paid subscription (Plus / Premium).
  • Subscriptions are billed through your Apple ID. You manage and cancel them in App Store → Subscriptions.
  • Auto-renews until cancelled in App Store settings, at least 24 hours before the end of the current period.
  • Refunds are handled by Apple per their policies.
  • Unused portions of a free trial (if any) are forfeited on cancellation.
  • Feature access may change based on your subscription state, device capabilities, app version, or service availability.

7. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, subject to these Terms and Apple's standard EULA.

8. Acceptable Use

See Acceptable Use Policy. The short version: don't abuse the service, don't break the law, don't infringe anyone else's rights, and don't try to circumvent rate limits or other protections.

9. User content and local library

The App does not currently let you upload your music library to our servers (music files stay on your device). If we add cloud sync in the future we will update these Terms and the Privacy Policy to describe what we store, how long, and your rights.

10. Analytics and diagnostics

Offbeat may collect consent-controlled analytics and diagnostic data as described in the Privacy Policy. Those systems are used to operate, measure, and improve the product and are not a license for users to upload or distribute content they do not have permission to use.

11. Exports, sharing, and third parties

When you export or share content, Offbeat may create temporary local files to complete the action. Final delivery depends on the destination, share target, storage provider, or external service you choose, and those third parties may apply their own terms and privacy practices.

12. Third-party services

  • Apple Music (optional). Your use of Apple Music via the App is governed by Apple's terms. We never upload your Apple Music library to Offbeat servers.
  • Supabase for authentication and subscription records.
  • PostHog for anonymous product analytics (EU host).
  • Google AdMob / UMP for Free-tier ads and consent messaging.
  • TikTok Business for anonymous ad attribution.
  • lrclib.net for optional lyrics search.

Each of these providers has its own terms and privacy policy.

13. Availability and limits

Offbeat is provided on an as-available and as-is basis to the extent permitted by law. Some features depend on device performance, supported media formats, system services, or network availability. We may update, change, suspend, or remove features at any time.

14. Disclaimers

THE APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP OR WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP OR WEBSITE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) €100. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

This limitation does not apply to (i) death or personal injury caused by our negligence, (ii) fraud or fraudulent misrepresentation, or (iii) any liability that cannot be excluded under applicable law.

16. Indemnification

You agree to indemnify us against any claim brought by a third party arising from your breach of these Terms or your misuse of the App or Website.

17. Termination

  • By you. Stop using the App; delete it from your devices.
  • By us. We may suspend or terminate your account if you violate these Terms. We will normally warn you first unless the issue is severe (illegal activity, security risk).

18. Governing law and disputes

These Terms are governed by the laws of Germany. Any dispute will be resolved exclusively in the courts of Berlin, Germany, except where mandatory consumer-protection statutes of your home jurisdiction give you the right to bring proceedings there.

The European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/. We are not obliged and do not agree to use that platform for disputes with consumers.

19. Changes

We may revise these Terms. We will post the new version here, on the Website, and bump the in-app version number. Material changes (new obligations, new sub-processors, changes to dispute resolution) require explicit re-consent in the App where required.
